Recently, in its judgment of 31 January 2024, the Court of Cassation clearly established the existence of a right to appeal against decisions refusing to propose commitments before the Competition Authority (hereinafter, the Authority). This decision, which at first glance might seem likely to offer a second chance to companies that have been refused their proposed commitments by the Autorité, will undoubtedly not have the expected impact due to the restricted control that should be carried out by the Paris Court of Appeal.
