In a decision rendered on 4 July last against Meta (formerly Facebook), the Court of Justice of the European Union (CJEU or Court of Justice) held that a competition authority may assess, as part of the examination of an abuse of a dominant position, the existence of a violation of the General Data Protection Regulation (GDPR). However, this possibility for competition authorities is accompanied by conditions of cooperation with the authorities in charge of the protection of personal data to ensure a consistent application of the GDPR.
