Law No. 2018-670 of 30 July 2018 marks a turning point in the protection of trade secrets, which until now was particularly vulnerable.
By transposing into French law Directive 2016/943/EU of 8 June 2016 on the protection of know-how and undisclosed commercial information (trade secrets) against unlawful acquisition, use and disclosure (JOUE, no. L. 157, 15 June) into French law, the legislator established an autonomous protective regime for trade secrets. Five years after the enactment of this law, practical questions remain about the implementation of this legislative arsenal.
